Terms of Service

Please read these Terms carefully. They are a binding agreement between you and Yummr. By creating an account or using the Yummr app, you agree to them. If you do not agree, do not use Yummr.

1. Who we are

Yummr is operated by DECK SEVEN ENTERPRISES, LLC, an Ohio limited liability company (“Yummr,” “we,” “us,” or “our”). Yummr is a mobile-friendly web app that helps people in and around Toledo, Ohio discover food and drink specials at local restaurants and bars, including a random “picker” that suggests a place to go. These Terms of Service (the “Terms”) govern your access to and use of the Yummr app, website, and related services (the “Service”). Reach us at jc.anicca@gmail.com.

2. Who can use Yummr

You may use Yummr only if you are at least 18 years old (or the age of majority where you live), can form a binding contract with us, and are not barred from using the Service under applicable law.

Because Yummr surfaces alcohol-related specials, you must be of legal drinking age (21+ in Ohio) to view, act on, or redeem any alcohol-related content. Yummr does not sell or serve alcoholand is not responsible for verifying anyone’s age at a restaurant or bar, that is the establishment’s responsibility. If you use Yummr on behalf of a restaurant, you represent that you are authorized to bind that business to these Terms.

3. Your account

Some features require an account. You agree to provide accurate information and keep it current, keep your password confidential, not share your account, and be responsible for all activity under it. Tell us promptly at jc.anicca@gmail.com if you suspect unauthorized use. There are three account types: patrons, restaurant owners/managers, and administrators.

4. The specials are crowdsourced, verify before you go

This is the most important thing to understand about Yummr.Specials, deals, prices, hours, and other details come from a mix of sources: other users, restaurant owners, publicly available information, and Yummr’s own research. We do not guarantee that any special is accurate, current, still offered, or honored by the restaurant.

• Always confirm a deal directly with the restaurant before relying on it. Yummr is a discovery tool, not a promise from any restaurant.
• Yummr is not a party to any transaction between you and a restaurant. Any deal or promotion is between you and that establishment.
• Yummr does not guarantee that any restaurant is open, in business, or will serve you.
• The “picker” suggests places for fun and convenience; suggestions are not endorsements and carry no guarantee about quality, availability, or safety.

Please eat, drink, and travel responsibly. Do not drink and drive. Your choices at any establishment are your own.

5. Rewards and points

Yummr may let you earn points for actions like reporting a special, and redeem points for rewards. The following applies to all points and rewards:

• Points and rewards have no cash value, are not your property, and cannot be sold, transferred, or exchanged for money.
• We may change, limit, expire, devalue, or discontinue points, rewards, earning rules, and redemption options at any time, with or without notice.
• We may withhold, reverse, or cancel points and void redemptions we believe were earned through fraud, error, abuse, duplicate or fake reports, or automated activity.
• Rewards fulfilled by a third party (for example, a restaurant honoring a redemption) are subject to that third party’s terms and availability. Redemptions are generally final and non-refundable.

6. Content you submit

“User Content” means anything you submit, reported specials, photos (such as pictures of specials boards, flyers, or menus), text, ratings, comments, and business information.

6a. Your responsibilities

You represent that, for all User Content you submit:

• you have the rights necessary to submit it and grant the license below;
• it is accurate to the best of your knowledge and not intentionally misleading;
• it does not infringe anyone’s intellectual property, privacy, or other rights;
• it does not contain unlawful, defamatory, harassing, hateful, obscene, or deceptive material; and
• you have permission to photograph and submit any image (no photos of identifiable people without consent, or copyrighted materials you don’t have rights to).

6b. License you grant us

You keep ownership of your User Content. You grant Yummr a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, use, reproduce, modify (for formatting and display), publish, distribute, and display your User Content in connection with operating, promoting, and improving the Service. This license continues for content others have interacted with or that we retain in backups or as required by law, even after you delete it.

6c. Photo scanning and AI processing

Yummr offers a feature that lets you photograph a specials board, flyer, or menu so the app can automatically read it and pre-fill a deal for your review. If you use it: your image and its text are processed by an automated (AI) system, which may include a third-party AI provider, solely to extract deal details; the results are suggestionsyou are responsible for reviewing; and you should not upload anything you don’t have the right to share.

6d. Moderation

We may (but are not obligated to) review, edit, refuse, flag, or remove any User Content for any reason, including inaccuracy or a Terms violation. We are not responsible for User Content submitted by others.

7. Acceptable use

You agree not to:

• submit false, fake, spam, or duplicate specials, or manipulate points/rewards;
• scrape, harvest, or bulk-download data, or use bots except through features we provide;
• reverse engineer, interfere with, overload, or gain unauthorized access to the Service;
• impersonate anyone, or falsely claim to represent a restaurant you are not authorized to manage;
• upload malware or violate anyone’s privacy or intellectual property; or
• use the Service for any unlawful purpose or in violation of these Terms.

8. Restaurant owners and claimed listings

If you claim or manage a restaurant listing, you represent that you are authorized to act for that business; you are responsible for the accuracy of what you post and for honoring the deals you advertise; you grant Yummr the license in Section 6b; and we may verify claims and revoke any we believe is unauthorized or abused. Yummr does not charge for basic listings today, but may introduce paid features in the future with separate terms disclosed at the time.

9. Intellectual property

The Service itself, including the Yummr name, logo, software, design, the “picker,” and all content we create, is owned by Yummr or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. Restaurant names, logos, and marks belong to their respective owners and appear for identification and discovery only; their appearance does not imply affiliation with or endorsement by those businesses or by Yummr.

10. Third-party services and links

Yummr may link to or rely on third-party services (hosting, an AI provider, mapping or website links, and the restaurants themselves). We are not responsible for third-party services, their content, or availability, and your use of them is at your own risk and subject to their terms.

11. Privacy

Your use of Yummr is also governed by our Privacy Policy, which explains what we collect and how we use it. By using the Service, you consent to those practices.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty that any special, price, hour, or listing is accurate or honored; that any restaurant is open or in business; that the Service will be uninterrupted, secure, or error-free; or that results from the picker or photo-scan feature will meet your expectations.

13. Limitation of liability

To the fullest extent permitted by law, Yummr and its owners, operators, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Service, including any reliance on a special or listing, any interaction with a restaurant, any food, drink, or alcohol you consume, or any travel. Our total liability for all claims will not exceed the greater of (a) the amount you paid us, if any, in the 12 months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Yummr and its owners, operators, and contributors from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

15. Suspension and termination

You may stop using Yummr and delete your account at any time. We may suspend or terminate your access, remove your content, or discontinue the Service at any time, with or without notice, including for a Terms violation. Sections that by their nature should survive termination (including content licenses, disclaimers, liability limits, indemnification, and dispute terms) will survive.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms with a new “Effective” date or notifying you in the app). Your continued use after changes take effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws rules. The state and federal courts located in Lucas County, Ohio have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to venue there.

18. Miscellaneous

These Terms (plus any policies referenced here) are the entire agreement between you and Yummr regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them (for example, in a merger or sale).
